Title: Ondo poll: Anxiety as Supreme Court fixes hearing for Sept 24
Post by: Mirror on Aug 23, 2013, 11:31 PM
Palpable tension gripped the people of Ondo State yesterday following the news that the Supreme Court has fixed September 24 for the hearing of the appeal filed by the defunct Action Congress of Nigeria, ACN and its candidate, Oluwarotimi Akeredolu, SAN, in the October 20, 2012 governorship election in the state.

The appeal of the Peoples Democratic Party, PDP and its candidate, Olusola Oke, in the election was similarly fixed for the same day.

It is believed that the date chosen by the Supreme Court falls outside the 60 days provided for hearing and determination of the appeal by the constitution, since section 285(7) makes it mandatory for the Supreme Court to hear the case within 60 days of the judgment of Court of Appeal.

The Supreme Court has up to August 29 to give its judgment in the appeal since the Court of Appeal sitting in Akure, the Ondo State capital, gave its judgment on July 1.

Observers believed that the hearing date of September 24 released by Supreme Court must have been an error in view of the constitutional provision.

Opposition party members in the state, who were anticipating that the judgement would come up latest next week, were gripped with anxiety.
