A CHIEF Magistrate's Court sitting in Osogbo, Osun State has insisted that the embattled Osun monarch, the Alowa of Ilowa in Obokun Council, Oba Adebukola Alli, who is standing trial for allegedly raping a 23-year old National Youth Corps member should remain in prison custody to answer the charges preferred against him.
The magistrate was unequivocal in his ruling when the case resumed yesterday, as he re-affirmed his order that the traditional ruler should stand trial while proper medical attention should be placed at his disposal in prison.
Counsel to the accused, Messer Victor Opara, Sunday Atofarati and Miss Ogonnaya Elekwachi yesterday brought an application before the court seeking for the vacation of its order of July 1, 2011 remanding the monarch in the prison custody.
The lead counsel, Opara, told the court that when his client was taken to Ilesa Prison, his ailment took a turn for the worse in the wee hours of the next day.
He claimed that prison doctors said the monarch had developed Bladder Retention (inability to urinate) and was groaning in pain for several hours.
But Makanjuola insisted that remanding the monarch in prison custody had not and would not hamper his medical care but even ensured his safety and afforded the court adequate reports concerning his medical status.
Consequently, he ordered that the monarch should remain in prison and that he should be transferred to the Intensive Care Unit (ICU) of the Obafemi Awolowo University Teaching Hospital Complex.
Further hearing on the matter was adjourned to July 11, 2011 while the court also ordered Dr. Adebayo to appear in court next sitting to give his medical opinion on the monarch's health condition.
