The Election Petitions Tribunal sitting in Akure on Wednesday declared Boluwaji Kunlere of the Labour Party as the winner of the Ondo South Senatorial District in the April 2011 poll.
The former Ondo State governor and Peoples Democratic Party standard-bearer in the poll, Olusegun Agagu, dragged Kunlere to the tribunal.
The tribunal dismissed the petition of the PDP, which challenged the victory of Kunlere over its candidate in the election.
Dismissing Agagu's petition, the tribunal, presided by Justice Aisha Bawa-Bwari, said its decision was based on the failure of the PDP to comply with paragraph 18 first schedule of the Electoral Act, 2010.
The Independent National Electoral Commission earlier declared Kunlere as winner of the election but the PDP, displeased by the result, challenged the agency's verdict at the tribunal.
