•DPP to appeal tribunal verdict
The three-man panel which sat in Asaba, the Delta State capital, on the rerun governorship election, yesterday told Chief Great Ogboru, the candidate of the Democratic Peoples Party (DPP) that he is not entitled to any of the relieves sought in his petition against Governor Emmanuel Uduaghan of the Peoples Democratic Party (PDP).
The panel said although the rerun was "substantially" conducted by the Independent National Electoral Commission (INEC) in line with the provisions of the 2010 Electoral Act, and the 1999 Constitution, Ogboru did not poll the highest number of lawful votes.
Following the petition instigated by Ogboru, the Court of Appeal, Benin, Edo State, on November 9, 2010, declared the election that produced Uduaghan in 2007 as fraudulent and ordered a rerun election within 90 days.
