The National Judicial Council (NJC) on Thursday, told the Federal High Court, Abuja, handling the suit of the suspended President of the Court of Appeal, Justice Isa Ayo Salami, that it would be impossible to reinstate him, because it was a completed act that could not be reversed through interlocutory application brought by the suspended PCA.
The NJC made this submission in a preliminary objection filed before the Federal High Court, through its counsel, Chief Michael Ozekhome (SAN), objecting to the suit filed by Salami.
Ozekhome said Salami could not ask for an interlocutory order, which had the effect of determining the substance of the main suit pending before the court and of which evidence viva voce would be required.
NJC, therefore, said an order setting aside an act already completed could not be granted by way of an interlocutory application, as doing so would amount to granting a relief and asking the maintenance of the status quo of an act already completed.
Furthermore, NJC argued that the whole matter was politically motivated, academic and moot, as the act of suspension of Salami had already been completed.
Meanwhile, criticism has kept pouring in for the acting Chief Justice of Nigeria (CJN), Justice Dahiru Musdapher, for gagging the NNJC over the suspended president of the Court of Appeal, Justice Salami.
