Title: Court frees 3 over poor prosecution

LAGOS – An Igbosere Magistrate's Court, Lagos, has struck out a N6.347 million charge against three persons; accused of fraudulently converting the said money from the Military Pensions Account, for lack of diligent prosecution.

The court held that the prosecution witnesses failed to appear for the trial.

In her ruling, Magistrate O. Awope said: "Prosecution is at liberty to file a fresh charge when and if they are able to assembly their witnesses," adding that  the defencecounsel in the matter applied for the case to be struck out since the prosecution witnesses have not been coming to court.

The defendants are Akibu Imhodagbe, 34; Aghaku Friday, 26 and Ojo Omusi, 31.

They were arraigned on a two-count charge of stealing and fraud.
