Title: Fourth tier of government unconstitutional – Party chairman
Post by: MrVan on Aug 09, 2012, 11:31 PM
The National Chairman, National Democratic Party (NDP) Mr Chudi Chukwuani, said on Thursday that the law establishing the fourth-tier of government in Imo State was unconstitutional.

Chukwuani made this known to the News Agency of Nigeria (NAN) in Abuja while reacting to a bill signed into law by Imo State Governor recently.

The law legitimises the establishment of 'community government council' as the fourth tier of government in the state.

The NDP chairman said the governor should not introduce fourth tier of government into the country's political system as the constitution recognised only three tiers of government.

"The governor should not be creating new constitution for the country, he sworn to the constitution of the Federal Republic of Nigeria which clearly state three tiers of government.

"These are the type of things that impact negatively on the image of the nation. It appears as if we are in a nation where people are not even obeying the constitution which they take oath to protect,'' he said.

Chukwuani said that it was punishable offence for the governor to introduce fourth tier of government in isolation.

"Imo alone cannot introduce the fourth tier of government without involving the Federal Government. It is a treasonable offence for a governor to act contrary to the composition of the constitution, somebody should make it clear to him,'' he said.
