Title: Top Kenyan judge resigns

Nairobi - Kenya's deputy chief justice resigned Thursday after a nine-month suspension following allegations she pulled a gun on a guard at a shopping centre.

"I have ... tendered my resignation as the deputy chief justice and vice president of the Supreme Court of Kenya," Nancy Baraza said in a statement.

Baraza was suspended in January after the incident with a security guard at the high-end Village Market shopping mall in Nairobi on New Year's Eve, when she reportedly refused to be searched.

Security guard Rebecca Kerubo claimed Baraza pinched her nose, and then pointed a gun at her. Baraza has said she regretted the incident but robustly denies pointing a firearm at the guard.

However, Baraza said she dropped her appeal after the chief justice backed her suspension.

"I do not see myself getting a fair and impartial hearing before  the court as currently constituted," she said.

She was appointed last year under a new constitution, part of wide-ranging reforms to make Kenyan leaders more accountable, after  bloody 2007-2008 post-election violence that left over a thousand people dead. - Sapa-AFP
