Suspension: A-Court dismisses suit seeking Salami’s re-instatement

Moves by the suspended President of the Court of Appeal, PCA, Justice Isa Ayo Salami to expedite the process for his return to office suffered a major set-back yesterday.

A five man panel of justices of the Abuja Division of the appellate court where he held sway until August 18, 2011, when he was axed from office by the National Judicial Council, NJC, in an unanimous ruling yesterday, dismissed a suit that was filed before them by the embattled PCA.

Specifically, Salami who was suspended from office over alleged judicial misconduct had gone before the appellate court to challenge the refusal of a Federal High Court in Abuja to transfer his matter to the National Industrial Court for proper adjudication.

He had in a motion filed pursuant to Section 295(2) of the 1999 Constitution, as amended, urged the trial court to stay further hearing on the substantive suit challenging the legal propriety of his suspension by the NJC, pending the outcome of his appeal, which was dismissed yesterday.
