Subsidy fraud: Agbakoba seeks to quash charges

Former Chairman of the Nigerian Bar Association (NBA), Mr. Olisa Agbakoba (SAN), has challenged the competence of the Economic and Financial Crimes Commission (EFCC) to prosecute suspected subsidy fraudster, Oluwaseun Ogunbambo and his co-defendants

EFCC had preferred a 10-count charge against Ogunbambo for allegedly using forged cargo and freight documents to obtain N976 million as subsidy claims from the Federal Government.

Agbokoba, who just joined the defence team, raised three major constitutional and jurisdictional issues against EFCC at an Ikeja High Court and urged the court to quash the charges against the suspects.

The first issue touches on what is referred to "Miranda rights" in legal parlance.

Miranda rights are secured rights of persons arrested or detained to have legal representation immediately on arrest and before making any statement.
