After the Presidential Election Petition Court upheld Bola Ahmed Tinubu’s declaration as the winner of the 2023 presidential election on September 6, PDP presidential candidate Alhaji Abubakar Atiku went to the Supreme Court to have the decision overturned.
In his 35-point Notice of Appeal, Atiku argued that the tribunal’s findings and conclusion in the petition challenging Tinubu’s declaration as President by the Independent National Electoral Commission, INEC constituted grave error and miscarriage of justice.
Atiku’s lead attorney, Chief Chris Uche, SAN, just filed an appeal with the Supreme Court asking it to overturn the Tribunal’s findings and conclusions because they misrepresented the case.

The ex-Vice President argued, among other things, that the Tribunal made a legal error by not nullifying the presidential election held on February 25, 2023, on the grounds of non-compliance with the Electoral Act, 2022, when, according to the evidence presented to it, INEC held the election on the basis of grave and gross misrepresentation, in violation of the principles of the Electoral Act 2022 and the “doctrine of legitimate expectation.”
