A group under the aegis of Yoruba for Socio-Cultural Development (YSCD) has called on the Islamic organization, The Muslim Congress (TMC) to stop promoting illegal monarchs in Osun State, stating that few Obas invited to grace their annual lecture, had been dethroned by the Court of Records and competent jurisdiction.
The group reacted to the Islamic organisation’s 18th Annual State Lecture programmes slated to be held on Monday, October 2nd, 2023 (17 Mon. Rabiu Awwal 1445AH) at Osogbo City Hall, Olonkoro, Osogbo, Osun State, where few illegal monarchs were invited, particularly, the deposed Alawo of Awo, Mr. Taiwo Rasaq Adegboye.
It would be recalled that the Court of Appeal, Akure Judicial Division in its judgment dated the 8th day of August 2022, where Taiwo Adegboye was an Appellant in Appeal N0:CA/AK/58/2021, dethroned Adegboye as Alawo of Awo by declaring him as an impostor and to stop parading himself as new Alawo henceforth.
Adding that the Appeal Court judgment delivered by the three courageous jurists of the Appellate Court, Akure, was clear and sound without any ambiguity but Adegboye refused to obey the Appeal Court judgement with the support of some lawless organizations like The Muslim Congress (TMC), Osun State branch.
Akure Division's Court of Apeal Judgement of 8th August 2022 on Alawo Stool - ExtractsRecalling that Taiwo Adegboye was installed illegally as the new Alawo of Awo on 13th of September, 2021 by former Governor Gboyega Oyetola without following due process of law, thereby making Taiwo Adegboye the product of fake and forged selection documents, a fraudulent process, illegal and revoked Chieftaincy Declaration and flagrant disobedience to Court pronouncements.
Describing the forgery act of Taiwo Adegboye with the recent Sixteen(16) years Mmesoma Ejike, the Student of Anglican Girls’ Secondary School, Urugu, Nnewi, Anambra State and 2023 Unified Tertiary Matriculation Examination (UTME) candidate who falsified and manipulated her result by jacking it up from (249 to 362) to outsmart other students in the national examination conducted by Joint Admission and Matriculation Board (JAMB).
Saying further that Taiwo Adegboye was also a Defendants in different Suits instituted by the people of Awo in Egbedore Local Government Area of Osun State, to show their total rejection of his illegal and unlawful installation as monarch of the ancient Appeal Court, had done justice by sacking him from the throne occupied illegally.
It listed the Suits as follows; HOS/84/2020, HOS/63/2021, HEJ/10/2021, HED/26/2020, HED/31/2020, HED/48/2021, CA/AK/58/2021, HED/07/2021 and SC/CV/1079/2022, adding that Taiwo Adegboye filed the Supreme Court Judgement against his dethronement in SC/CV/1079/2022, to cover his forgery and fraudulent acts.
The Yoruba group, Yoruba for Socio-Cultural Development (YSCD), further supported its argument with the Supreme Court decision in the case of Abacha V. Fawehinmi (2002)2 SCNQR 489 at 546 thus,” ….. It is the law that a decision of a Court of competent jurisdiction, no matter that it seems palpable null and void, unattractive or unsupportable, remains good law and uncompromisingly binding until set aside by a superior Court of competent jurisdiction”.
Also stated that the Supreme Court had maintained that the Order of the Court must be OBEYED by all and sundry as contained in the case of Governor of Lagos State Vs. Ojukwu, referring to the Supreme Court in the case of Ezekiel Hart v Ezekiel —-Hart, 222 Wali, JSC(as he then was), per Rhodes-Vavour( JSC, as he then was) in the case of Chief Ujile D. Ngere &1Or V. Chief Job Williams Okuruket “X1V” & 3Ors (2014) 11NWLR pg.173 para G-H, SC.1/2020- PDP & 2Ors. V. Biobarakuma Degi-Eremienyo & 3Ors(2020)9NWLR(1781)P.274, Supreme Court in FASADE VS. BABALOLA, Chief Okoya& Ors. Vs. Santilli &Ors. (1997)7 NWLR (part 206)753/766; and SC.19/1997.
According to the press statement issued by YSCD Coordinator, Mallam Adekola Aleem and made available to Journalists at the weekend, disclosed that only organizations like The Muslim Congress (TMC) could be promoting the illegality by joining the gang of contemnors, adding that the action of the Islamic organization was liable to imprisonment.
Mallam Aleem urged the Islamic organization not to allow Taiwo Adegboye to appear in their programme as Alawo of Awo in respect to the Appeal Court Judgement, that has sacked Adegboye from the throne of Alawo Stool, adding that “this is what led to the disgrace of some Obas in the hand of former President Olusegun Obasanjo at a recent programme in Oyo State of Nigeria”.
