The All Progressives Congress, APC, appeal seeking to nullify the victory of the member representing Birnin Kudu seat, Muhammad Kabiru Yayannan, of the Peoples Democratic Party, PDP, was denied by the Jigawa State House of Assembly Election appeal Tribunal, which was sitting in Dutse.
The case had been submitted by the All Progressives Congress, APC.
The case that was brought on behalf of the APC by Surajo Muhammad Kantoga was rejected by the three-person panel on Monday.

The ruling, which was led by Justice Agada Okeke and included a unanimous vote, confirmed the PDP candidate as the lawfully elected member who will represent the Birnin Kudu seat.
Earlier, Kantoga made a request to the tribunal, asking them to declare him the victor of the election that took place on March 18 and to revoke Yayannan’s Certificate of Return.
The petitioners claimed that the PDP candidate did not meet the requirements to compete in the election and that the election itself did not comply with the requirements outlined in the Electoral Act of 2022.
According to Justice Agada, the petitioners failed to substantiate the case of irregularities that were alleged in the petition. As a result, the petition was rejected for lack of merit because it did not have any merit.
Laminu Bala, the attorney for the defendant, has stated that he is pleased with the decision made by the tribunal.
Abdurrahman Muktar, the attorney for the petitioner, stated that they will review the ruling and then decide what their next course of action will be.
