Bauchi State High Court Seven has issued an interim order prohibiting Babayo Misau from presenting himself as the substantive chairman of the All Progressives Congress (APC) in the state.
The order, granted pending the hearing and determination of a Motion on Notice, stems from a legal dispute between APC Concerned Citizens and Babayo Misau.
The suit (No/BA/07/992/2023) brought by APC Concerned Citizens alleges that Misau violated party regulations and worked against the party’s interests in the recent state governorship election.
Isa Mohammed, counsel to the plaintiffs, filed a motion, claiming that Misau’s actions contravened party laws and adversely affected the party’s success in the 2023 governorship election.
Mohammed argued that restraining Misau was essential to prevent potential chaos among aggrieved members.
Responding to the application, Justice Lamido Kabir Umar, presiding over the court, granted the order restraining Babayo Misau from acting as the State chairman.
The court directed the parties to expedite their case within 14 days, emphasizing the need for a swift resolution.
The motion on notice hearing is scheduled for December 11, 2023.
It is worth noting that the party had previously expelled Misau in April, accusing him of engaging in anti-party activities that undermined the party’s success in the general elections.
