Kabiru Mohammed Shanono was brought before Justice Aisha Mahmud of the Kano State High Court on Wednesday, July 5, 2023, by the Economic and Financial Crimes Commission (EFCC). He was charged with criminal misappropriation.
According to the allegations, the defendant received two trucks of maize valued at N18,537,390 (Eighteen Million Five Hundred and Thirty-seven Thousand Three Hundred and Ninety Naira) from the complainant, with an agreement to make full payment upon the sale of the goods. However, he failed to fulfil the agreement and only remitted N13,400,000, diverting N5,137,930 for personal use.
During the course of the investigation, the defendant paid an additional N1,000,000 to the complainant, leaving a balance of N4,137,390.
The charge against Kabiru Mohammed Shanono stated that he knowingly and dishonestly misappropriated the outstanding amount of N4,137,390, which was the purchase price of the two trucks of maize sold on behalf of Alhaji Shuaibu Alhassan to Infinity Snacks and Beverages Limited. Instead of remitting the funds to Alhaji Shuaibu Alhassan, the defendant converted it for personal use. The offence committed is in contravention of Section 308 and punishable under Section 309 of the Penal Code Law of Kano State.
Upon hearing the charge, the defendant pleaded not guilty.
Following the defendant’s plea, the prosecution counsel, Clinton Wilson Okereke, requested a trial commencement date.
However, the defence counsel, GY Gambo, applied for bail on behalf of the defendant. The prosecution counsel opposed the bail application, citing that it was served on him only on the morning of the arraignment. He requested time to respond with a counter affidavit.
Consequently, Justice Mahmud adjourned the matter until July 17, 2023, for the hearing of the bail application.
In the meantime, the defendant was remanded in EFCC custody pending the hearing and determination of his bail application.
