The Court of Appeal sitting in Abuja, the nation’s capital, has dismissed the appeal filed by the former Chairman of the People’s Democratic Party (PDP) in Ogun state, Mr. Samson Bamgbose and his co-travellers seeking to upturn the 22nd of June, 2021 consent judgment of the Federal High Court, Abuja.

Bamgbose and five others, including their sponsor, Mr. Segun Seriki, had tried in vain to attend the National Convention of the party held in Abuja between the 30th and 31st of October, 2021.
They had approached the Federal High Court, Abuja, to seek interlocutory injunction that would enable them to attend the convention. When they failed in their bid, they decided to approach the appellate court.
Delivering its judgment on the interlocutory appeal today (Monday, 25th April, 2022), the Court of Appeal dismissed the appeal for being incompetent.
The court held that appeal was incompetent because the appellants (Bamgbose and others) failed to seek the leave of the either the trial court or the appellate court before filing the appeal.
The court further ruled that other issues raised in the appeal were academic in the circumstance and were therefore not considered.
It ordered that the trial court should give an accelerated hearing of the substantive case.
“Parties to bear their respective cost,” the court held.
It would be recalled that the Federal High Court, Abuja, as per the Hon. Justice M.O. Olajuwon, had on the 22nd of June, 2021, affirmed Bamgbose’s suspension.
Again, the Federal High Court, Abeokuta, as per Justice Joyce Obehi Abdulmalik on the 18th of February, 2022, dismissed the suit filed by Bamgbose against his suspension.
Earlier, the Federal High Court, Abuja, had entered as judgment of the court the terms of settlement executed by Barrister Taiwo Shote (a.k.a Pepe) on behalf of the Kashamu political family with the Hon. Sikirulai Ogundele-led State Executive Committee on the 18th of March, 2021.
