Five dissatisfied members of the Peoples Democratic Party (PDP) in Kaduna State have secured an ex parte order from the Federal High Court in Abuja, effectively halting the state congress and elections initially scheduled for Saturday, September 21.
The court’s ruling restrains both the party and the Independent National Electoral Commission (INEC) from proceeding with the congress until a motion on notice for an interlocutory injunction is resolved.
The legal move was initiated by M. A. Mahmud (SAN), counsel for the aggrieved PDP members, who filed the ex parte motion in court.
The plaintiffs — Nura Waziri, Mutari Shuiabu, Yusuf Suleiman, Mallam Mansur Alasan, and Ja’afar Abubakar — are challenging the conduct of the congress and elections, prompting the court to intervene.
In a letter dated September 18, Mahmud (SAN) formally notified the INEC Chairman of the court order, requesting that the commission refrain from participating in or monitoring the scheduled congress in Kaduna.
The legal action is seen as an attempt by the aggrieved party members to address concerns over the internal processes leading up to the state congress.
The court’s decision has introduced uncertainty into the PDP’s plans for the congress in Kaduna, as the party must now wait for the court to rule on the interlocutory injunction before proceeding with any further electoral activities in the state.
