A legal practitioner, Obunike Calistus Ohaegbu, has dragged the Nigeria Democratic Congress, NDC, before the Federal High Court in Abuja over the alleged failure of the party to announce the result of its primary election for the Nnewi North, Nnewi South and Ekwusigo Federal Constituency of Anambra State.
The suit, marked FHC/ABJ/CS/1219/2026, concerns the primary election conducted on May 29, 2026, to select the party’s candidate for the 2027 House of Representatives election.
Ohaegbu, who participated in the primary, claimed that he secured the highest number of lawful votes but that the result was not declared at the venue.
He is asking the court to declare him the validly elected and nominated candidate of the NDC for the constituency and compel the party to submit and upload his name and particulars to the Independent National Electoral Commission, INEC.
The plaintiff is also challenging an alleged directive that the primary result should not be announced at the venue but only at the party’s national headquarters.
He wants the court to determine whether such a directive could lawfully be used to suppress, alter, substitute or withhold the declaration of the primary election result.
Ohaegbu further asked the court to restrain the NDC from recognising or submitting any other person as its candidate for the constituency and to prevent INEC from accepting or acting on the name of another candidate.
The NDC, Ebere Onunkwo, Socrates Ebo, INEC and Peter Uzokwe were listed as defendants in the suit.
At the proceedings, the case could not proceed after the court discovered that some of the defendants had not been served with the mandatory hearing notice and were absent.
Justice Mohammed Umar consequently adjourned the matter until October 14, 2026, directing that evidence of service on all parties must be presented before the next hearing.
The suit is expected to determine the dispute over the party’s nomination for the federal constituency as political activities intensify ahead of the 2027 general election.
