(Conduct Tribunal News) – The Code of Conduct Tribunal sitting on Wednesday March 12, 2014 in Abuja has stricken out the suit against Margret Nzonbato, a serving Commissioner of Youth Development from Adamawa State.
While delivering his judgment in the tribunal’s complex in Abuja, the Chairman of the Code of Conduct Tribunal, Danladi Yakubu Umar (Justice) along with two other members of the tribunal, William Agwadza Atedze and Robert Ewa Odu (Justices) unanimously stroke out the suit based on its non-compliance to the rules of the tribunal.
“This honourable tribunal has agreed with the Defence Counsel on the grounds that the Prosecuting Counsel has failed to comply with the rules of the tribunal as such the matter is hereby stricken out and the accused discharged,” the Judge hinted.
Speaking earlier, the Prosecuting Counsel, Peter Danladi (ASC) mentioned that the matter was slated for presentation of the witnesses, but the Defence Counsel for the accused Aliyu Ahmad objected to the move and pointed out its defect from the point of law.
Aliyu Ahmad said that the charges filed by the prosecutor undermined the rules of procedure established by the tribunal, indicating that the charges cannot stand as it failed to meet order number one of the rules of the tribunal. He did not agree to the charge of affidavit and proof of evidence which was to support the charge. He therefore, prayed the court to strike out the case contained in file No: CCT/ABJ/04.
