The Benue State Chapter of the All Progressives Congress (APC) has filed an appeal at the Court of Appeal, Makurdi Division, challenging the judgment of the Benue State High Court, which reinstated Austin Agada and other executives of the party.
The appeal, filed on Friday by the APC through its counsel, Mathew Burkaa (SAN), seeks to overturn the ruling delivered by Justice T.A. Kume on November 28, 2024, in favor of Agada in a case involving the enforcement of fundamental human rights.
In addition to the appeal, the APC has filed a motion at the High Court for a stay of execution on the judgment, pending the determination of the appeal.

The party’s motion includes two prayers:
- An order restraining the 1st to 9th respondents from enforcing or benefiting from the High Court’s ruling until the appeal is resolved.
- An order staying the execution of the judgment, pending the appeal’s outcome at the Court of Appeal.
Meanwhile, the APC Caretaker Committee Chairman in Benue State, Benjamin Omale, has urged party members to remain calm and continue their lawful activities, assuring them that there is no cause for alarm as the legal process is underway.
The case has drawn significant attention within the party and the state, as it impacts the leadership structure of the Benue APC.
