The Federal High Court sitting in Abeokuta, today, July 13, 2023, dismissed the suit filed by Hon Dr Sulaiman Adeniye and the Peoples Democratic Party (PDP) against Jide Owodunni and the Independent National Electoral Commission (INEC) purely on procedural grounds and not on the merit of the case.
Justice Adefunmilola Ajayi while agreeing to the withdrawal of Jide Owodunni from the 2023 election and defection to All Progressives Congress (APC) only faulted the plaintiff originating summon procedure which doesn’t give room for cross-examination of the defendant based on the content of his counter affidavit. She said a writ of summon was more appropriate in this case which allows the cross-examination of the defendants and witnesses.
The public should kindly note that the judgement delivered by Justice Ajayi DID NOT DECLARE BABAJIDE OWODUNNI AS THE LEGITIMATE OGHA CANDIDATE FOR IKENNE STATE CONSTITUENCY.
Justice Ajayi merely opened the window for the appeal of the ‘ procedural ‘ judgement.
By this, Hon Sulaiman Adeniye is set to appeal the judgement at the Court of Appeal where the merit of the case will be the consideration.
The members of the Peoples Democratic Party in Ikenne Local Government are enjoined to remain calm as justice will be gotten in a short time. Justice delayed is not justice denied.
